Welcome to Growing Mindfully. These Terms of Use ("Terms") govern your use of the website at growingmindfully.org, our online waitlist and enrollment application, and the forms and email connected to them (together, the "Site"), which are operated by Present Pathways, Inc., a California for-profit corporation doing business as Growing Mindfully ("Growing Mindfully," "we," "us," or "our"). Please read them carefully. By using the Site, you agree to these Terms.
1. Acceptance of these Terms
By accessing or using the Site, applying to our waitlist, or submitting information through our forms, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Site. If you are using the Site on behalf of another person (for example, a co-parent or guardian), you represent that you are authorized to do so.

3. Using the Site
The Site is intended for parents and guardians who are at least 18 years old. It is not directed to children, and we ask that children not use it. You agree to use the Site only for lawful purposes and to provide accurate, current, and complete information when you apply or communicate with us. You agree not to:
- Interfere with, disrupt, or attempt to gain unauthorized access to the Site, our systems, or another person's application or account;
- Use the Site to transmit anything unlawful, harmful, or fraudulent, or to impersonate another person;
- Use automated means to scrape, copy, or overload the Site, or attempt to circumvent any security or rate-limiting measure; or
- Use the Site or its content for a competing commercial purpose.
4. Waitlist applications and enrollment
Applying to our waitlist does not guarantee a placement, a specific position, or enrollment. Availability, waitlist position, tuition rates, priority eligibility, fees, and start dates are estimates that can change, and any figure shown on the Site is for general information only. A one-time waitlist fee may apply to complete an application, and a deposit may apply to reserve a space; fees are described at the point of payment.
5. Email and communications
When you provide your email address or phone number (for example, by applying to our waitlist), you agree that we may contact you at that address about your application, your child, and your account, and that we may send you occasional news, updates, and promotional messages about our program. Every promotional email includes a way to unsubscribe, and we honor unsubscribe requests promptly. Unsubscribing from promotional email does not stop essential transactional messages about your application or account (for example, verification, confirmations, and offers). How we handle your information is described in our Privacy Policy.
6. Payments
Payments made through the Site are processed by our third-party payment providers (Stripe, and Brightwheel for enrolled families). By making a payment, you also agree to the applicable processor's terms. We do not collect or store your full card or bank-account number on our own systems. Refund eligibility for any waitlist fee or deposit is described at the point of payment or in your enrollment agreement.
7. Intellectual property
The Site and its content - including text, graphics, logos, the Growing Mindfully name and marks, photographs, and page design - are owned by or licensed to Present Pathways, Inc. and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable license to view and use the Site for the purpose of learning about and applying to our program. You may not copy, reproduce, distribute, or create derivative works from the Site without our written permission, except for personal, non-commercial use.
8. Third-party links and services
The Site may link to or rely on third-party websites and services (for example, our payment, analytics, e-signature, and child care management providers). We do not control those third parties and are not responsible for their content, practices, or terms. Your use of a third-party service is governed by that party's own terms and privacy policy.
9. Disclaimers
The Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that any information on the Site (including availability, position, pricing, or dates) is accurate, complete, or current. Nothing on the Site is professional, legal, medical, or financial advice.
10. Limitation of liability
The limits in this section apply to your use of the Site (this website and online application). They do not apply to, and nothing in these Terms limits, our responsibilities for the care and safety of enrolled children, which are governed by your enrollment and admission agreement and by California child care licensing law.
To the fullest extent permitted by law, Present Pathways, Inc. and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or profits, arising out of or relating to your use of (or inability to use) the Site, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total liability arising out of or relating to the Site will not exceed the greater of the amount you paid to us through the Site in the twelve months before the claim, or one hundred U.S. dollars ($100).
Nothing in these Terms excludes or limits our liability for fraud or fraudulent misrepresentation, for gross negligence or willful misconduct, for death or personal injury caused by our negligence, or for any other liability that cannot be excluded or limited under California or other applicable law (including California Civil Code section 1668). Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Present Pathways, Inc. and its owners, officers, employees, and agents from any claims, damages, losses, and reasonable costs (including attorneys' fees) arising out of your misuse of the Site or your violation of these Terms or of any law or third-party right.
12. Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Sacramento County, California, and you consent to the personal jurisdiction of those courts. If any provision of these Terms is found unenforceable, the remaining provisions stay in effect.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Effective" date above. Your continued use of the Site after a change means you accept the updated Terms. Please review this page periodically.
